Condition 10 of Planning Consent C03/0310 states that; 'the premises herein referred to shall be used for holiday letting accommodation and for no other purpose (including any purposes in Class C3 of the schedule of the Town and Country Planning (Use Classes) Order 1987). the duration of occupation by any one person, or persons of any of the units shall not exceed a period of three month in any calendar year, unless otherwise agreed in writing by the local planning authority'. The property (Avocet Cottage) has been let and occupied as a residential dwelling and let on a number of Assured Shorthold Tenancy Agreements (ASTA's) for a period of 68 months prior to the current application for a Lawful Development Certificate. A Lawful Development Certificate is sought to retain the use of Avocet Cottage as a dwellinghouse in accordance with Class C3 (a) of the Use CLasses Order.
