Variation of Condition No.3 of DC/22/3202/FUL - Condition 3 of the planning permission states that "Construction activities will only be undertaken between 1 October and 14 February (inclusive) to avoid the kittiwake nesting season at the Port of Lowestoft. No construction activities will be undertaken outside of this period." Although the Norfolk Projects intend to complete all works prior to the 14 February, there could be unforeseen circumstances which may prevent this such as adverse weather and sea conditions. It is noted that the reason for condition is to protect other kittiwakes within the port from disturbance. However the proposed works are largely sheltered form the ports existing kittiwake nesting sites by an existing 4 m high wall and therefore a small increase in the construction period is very unlikely to affect them. Therefore the applicant is seeking to vary condition 3 to state that activities will only be undertaken between 1 October and 28 February.
